I'd say no. The Gothamite category is meant for normal everyday workers of Gotham city. People with secret super identities do not sound very normal to me. -
While we sometimes allow under-18 members if they show enough maturity, declaring you're underage in a public topic like this is not a very smart move. Be aware all we'll keep a special eye on those members in this situation.

A reasonable ammount of overhang, let's say 1-2 stud(s), is accepted. If there's a minifig's limb overhanging, it's accepted too. Let's just not try to make a bignette out of a vignette on the basis of overhanging! -

PNG files have the characteristics described in this wiki page. Basically, they came in to replace GIF files, as smaller in size, but with better resolution (connected with the sampling method) than JPG files, especially when using them for images containg text and other graphic elements (for photos with soft, low-contrast transitions, JPGs are still the best). Moreover, it allows transparency, whereas JPG atuomatically replaces it with a white background. -
Try following these instructions. The main thing is you have to choose the right size before copy/paste the image url.

As others have notes, and saying I hope I'm mistaken, I must say it looks more like a photoshop mix of Iron Man mk VII (armour details and helmet) and the TC-14 (chroming and lower half of the body) and Hulk (background and part of the pose) hi-res images. The chroming details are the same, to the point there is a reflection of the hand on the right (minifigure) side of the hips piece, which is ok for the original TC-14, but should not be there given the position of this fig's hand. That's the arm's pose of the Hulk promotional. Moreover, why should it have the 'repulsors' round bricks for the hands, but not for the feet (where they would make more sense)? Maybe trans-light blue pieces where too difficult to photoedit like the rest? Finally, as far as I know (my checks did not find anything, but I may be wrong) there is no signature in the lower right corner of other LEGO promotional images like this one has. Again, I hope to be wrong, but I would not be surprised if I weren't.

After consulting with The Penguin and checking few additional details, like used parts release dates, we have come to an agreement to accept your entry. I'm sorry for the misunderstanding, but lacking better evidence, we have to resort to the Exif data. Please check your camera's date/time are correct next time. Please keep in mind it is still not up to the rules requirements (more views of the custom figure, complete backstory [as it is, nothing tells us why/how he is a villain], estimated cost, etc...). Fulfill all those aspects (you've plenty of time) to qualify.
