Right, I have been asked to create this thread to raise awareness.

I am spearheading a way to solve this, as I have knowledge in this sector.

We have someone in our community that has been taking LDD files that don't belong to him, has been making videos on them without the original designers permission, and most importantly has been selling the designs as instructions when he has no right or legal standpoint to do so.

 

Now, this is not giving anyone the right to give this guy 'hate' as it will not make the situation any better.

 

Firstly, I recommend you read the thread created by @Tenderlok, that started nearly a day ago, and has brought this to the forefront:

 

And especially this bit that I wrote just recently in there:

Today I am incredibly disappointed by @Jimbricked...

It seems he isn't listening, he seems infact to be saying one thing, doing another...

I'm beyond frustrated with this situation, so this is closer to the line that we as community should take:

This is not to open the door to giving him 'hate', this is a group approach to solve this, and I need help as I am only one man.

In terms of consequences, this will now be in a far less beneficial light for @Jimbricked, because of his lack of action.

He is now likely going to have to remove videos on people asking, or otherwise get an awful lot of copyright strikes...

Right, the plan:

1. Go on his channel.

2. Look though all his videos, and:

(a) If they're your LDD designs, contact him and ask him to delete them, as it doesn't look like he's going to be contacting you anytime soon...

If he doesn't respond, fill out the infringement form on Youtube.

(b) If you directly know who the LDD design originally belongs to, could you please find contact details for the designer in question, and pop them a message explaining the stolen material is monetized and also has instructions being sold by Jimbricked.

From there the designer needs ask him to delete them, and again, if he doesn't respond, they should fill out the infringement form on Youtube.

Therefore, we have legally forfilled the correct approach, by asking first, then if no response, using Youtube's tools to deal with it.

Now @Jimbricked, as you may know, if too many people send copyright strikes on your channel, Youtube is within their rights to terminate your channel...

I recommend you cooperate with this or Youtube could in a sense 'slap the book at you' and you'll be left with no channel at all. I have seen this happen.

The other approach which could save everyone time would be to delete every piece of content (video) in which you have used LDD files without permission.

That would leave you with the designs you have created entirely yourself, and the possibility of being able to continue uploading your designs in video form to Youtube.

In this scenario, you can sell your own designs, but not those belonging to others as well...

The "plan" part specifically is what I need help with.

So, any would be much appreciated to solve this.

If you know anyone affected in the form of stolen material please do get in touch with them, if you don't have contact details for them, please refer it to me and I will either search for info and contact them or get someone else on it with more links.

Hi,

Thank you for posting.

All videos that are not mine will go onto private until I get permission. For builds where I don't get permission or can't get into contact with them, I will simply delete them.

I totally went about those the wrong way and I am grateful for the LEGO Community for making me understand.

I will be contacting 300+ creators (to my best ability) to get permission through an agreement form (signed by both parties).

If there is ANYTHING else I can do, please, feel free to speak.

I'm all ears and am in 100% cooperation. Owning up to my actions and assuming responsibility.

The problem with that is who's word will we be going on that you've actually received the permission? Your word or the builders word?

The builders. I will make them sign a "agreement form". They will sign yes or no basically, and both parties will receive the same copy. :)

It should be only fair that with signing that agreement, you grant the original designers a share of the revenue generated by their content.

You still have dozens and dozens of videos that you haven't removed! Most are from last year or earlier. Please tell us, again, how since you lost the creators name for those older MOC'S you're doing everything possible to contact them. B.S.! ALL the videos for which you don't have explicit written permission need to come down! Immediately! Just because they don't yet know you're stealing from them doesn't make it okay! It's NOT okay to leave them up until they tell you to take them down!

It's your choice, do you want a channel that has very few videos left on it or do you want to lose your channel entirely due to copyright violations?

You want to prove to is that you're doing everything possible? Take them all down!

PS, I got your message, no you cannot have my email and no I don't give you permission to post or profit from my work!

I have explained this to him, and I hope he is taking this fact on board...

I'm waiting to see how many videos have to go, I'm sure it'll be a fairly large number from what people I've been speaking with have been saying...

I'm looking forward to the video explaining all this in great detail! 😂

All videos in which I had no permission are gone. All of my creations will still be up as well as ones i have proof of permission for

He is also breaking the rules at LEGO IDEAS. One of their rules is ...

You MAY NOT SELL ANYTHING related to your project.

You may share photos and building instructions free of charge on your own website and online profiles. However you may not sell building instructions, custom kits, or anything related to your project. We will remove projects without notice if we learn you are commercializing content submitted to LEGO Ideas.

On youtube he is advertising the sale of instructions for both the casino and UP house that he has entered at IDEAS:

I do know the facts, you are selling instructions for an IDEAS submission. This is not allowed, as you agreed to the IDEAS rules. "However you may not sell building instructions"

 

And come to think of it, M7ROCK is also breaking the IDEAS rules, since he has given permission for you to sell instructions.

I understand where you're coming from,

Just because the option is there, doesn't mean I sell it.

My descriptions are edited in bulk meaning, if you look at every one of them, they are the same.

I hope this explains this confusion.

You are advertising them for sale - that is commercialization. And M7ROCK has submitted that project to IDEAS, so he is breaking their rules.

The same with your casino and UP house.

Hmm, I don´t think so.....

To state it clearly. I absolutely don´t advocate what you have done! I don´t like commercialization at all, and in particularly not if unauthorized!

 

But: You have  13k subscribers, and I think you make them happy with your videos..... Anyway, thats no excuse, but maybe a good basis to do something more right?! Stating somewhat more obvius that the MOC is not yours and something about the original developer would be a first step IMHO.

 

I think the main problem is way more bigger than only one YT-channel. Youre are not the first doing some infringement, and you wont be the last.

Maybe it is time now to start a general discussion about how-to publishing, sharing and using MOC´s files, pictures, instruction or whatever.

I am neither good in law-issues, nor are my english-skills sufficient enough to understand ToU or explanations of public licenses without any doubt. But i know that things like GNU exist. However, I have never seen a MOC published under a GNU license.

On the other hand, I often find interesting MOC´s or building techniques online wich I use for my own. I have never posted such MOC´s, also because I tried to avoid any infringement. In other words, because I am uncertain how to do it "the right way". So maybe use of public-licenses can be helpfull for both sides?

 

Yes, jimbricked has gotten things into a mess, but can anyone really exspect things will become better whithout changing something?

 

I have not a clue how to do it the right way, but in my opinion, the community should discuss and find a way to act in future. Also to give both, MOC- developers and MOC- rebuilders a little bit mor safety about what is allowd and what needs additional permission/ is not allowed.

TLC has stated some Terms of fair play. I think we could do something similar....? Or just use GNU´s?

Jim, please don't turn your entire channel down.

I don't have the time to write an elaborate answer here, as the topic is very delicate and people have fuelled this topic to simply ballistic proportions, so I better be careful not to get into the crossfire.

I did of course jump to your channel and browsed through it, once I heard about it. You know what? Of course I found many instructions, which are not yours, but I found them neatly lined up and very well prepared. How many times have I read in this forum: "Can't find this, can't find that". RailBricks down, we were all crying. Things splattered around BrickShelf (my own stuff is in there as well, don't get me wrong!) - a website with a design and functionality from the first days of the internet. And I am glad it exists, because I am too dumb to make it any better myself, nor do I have the time to do so. And then your nicely assembled a collection of unfortunately "stolen" content. Oh well. Read my opinion in the TrainTech thread.

Could it be that you are not almost 60 years old, as I am? That I may have lets say 40 plus years of hanging around in this world and having had the chance to learn about IP, about free content, about what happens, when you step on (apparently big) feet? Fact is, most of the "affected" people did never realize this at all, although YT is available virtually everywhere in the world. Hmmm. And then all hell breakes loose, because it is brought to our attention. As in "presented" to us.

Wrapping up (would love to talk to you in person):

  • You royally f'ed up with regard to "IP" handling. Let us call "IP" better "my idea". Legally, IP really is a big word. How may people on EB have filed patent applications? It is madness. I have to. I believe IP is regarded here more as "my idea rights". I may be wrong. Filing a patent means not talking about it >at all< and certainly >never< on the internet. Patents are intended to protect your ideas, because >you want to make money<. And you don't talk about it at all. So all people talking about "IP rights" and "not wanting to make money" are saying "this is all about moral". Phew. Another very big word. 
  • You responded - as far as I am concerned - in the right way - given the time frame (we are talking about less than a day or two, with I don't know how many people firing at one single person: you). And they made their points very clear. 
  • Become more aware of the "art of asking people for permission". When you do that in a "polite" way, almost all of them will be glad to help out. It is in the nature of the people creating EuroBricks and others sites. This site is in the public domain - but not for poaching. 
  • Your YT channel is impressive - to me. I enjoy it very much!!!

Again, please don't turn it down.

And: There is no hate here. There is >bold<, but constructive criticism. If not, I'd quit EB >today<. Don't take "bold" inquiries from (old experienced people) too serious. You have answered every question in a fresh, friendly, positive way. IMHO. That may irritate "experienced" folks. They want to see - other things. "I am sorry" may not be enough. And "Have a nice day :)" is then a not so clever salutation.

I am prepared to get a lot of flak for this - we then share a common thing :)

Socialblade is relatively inaccurate, and will be off by a bit (as I have been told by people in the know), but gives you an idea:

Think we talk about two different pairs of shoes, don´t we?

Fitst thing is selling MOC-Instructions via YT, that was complaint about from the first post in this thread.

Now you are talking about generating money with his YT Channel. Well, I have never seen any (of this annoying) commercials when watching jimbricked viedeos. So you allready get payed by YT even when not allowing their commercials?

Sorry. I am not so deep in that YT stuff to understand fully. At the moment, I think its a sign of not been only/fully commercial that I have never seen an advertisement @Jimbricked YT-Channel?!

Maybe I need some explanation on that?!

When all 300+ videos were up I clicked through a number of them and hit an ad on each one. Cleared all browser history, closed browser, reopened and went again multiple times throughout the day Wednesday and same thing. Its possible they changed something between the original thread (in Train Tech), the questions and mentions over there and here of the remunerative potential of 10,000,000 views and you not seeing any ads sometime before all the content was removed.

Thanks for posting that. On the one hand they said they didn't generate very much from the sale of instructions but on the other hand the use of all those other people's involuntarily displayed and uncredited content on their channel could have made it a very lucrative operation as suspected.
