It clearly could be Treebeard, but by not naming him it leaves open the possibility of them making a stand alone Treebeard set with him, Merry and Pippin in some future wave. Naming him in the Orthanc set doesn't really impact sales of that set. But by not naming him in it, it keeps any future set as a more desirable must have. Quote

Right, but the point was they have the exact same figure and are trying to sell it as two different types of orcs. It doesn't matter if he is a special character or not, he is named something different but there is literally no differentiating him from any other Mordor Orc released so far. Quote
